Rio City Hall suspended the operation of bank branches to avoid crowds and, therefore, contain the spread of the coronavirus. The Public Prosecutor's Office and the Public Defender's Office filed a public civil action asking for the measure to be revoked.
In his decision, judge João Luiz Lima stated that the ban on the operation of bank branches did not take into account that elderly people do not usually have the skills to deal with online systems. Furthermore, many operations require the presence of the holder at the establishment, he highlighted, citing large transactions and payments to needy people.
“Thus, without ignoring the best intentions of the municipal entity, aimed at protecting the health of the elderly, the fact is that the restriction gives on one hand, but takes away from the other in a radical way, allowing the occurrence of situations in which this group will end up be deprived of cash essential to subsistence, which is why, in addition to the smoke of good law already demonstrated, there is a danger in the delay in judicial provision”, pointed out the judge.
If Rio City Hall fails to comply with the injunction, it will have to pay a daily fine of R$500,000.
